Substituting O’s Beneficiaries

Since O-1 petitions relate to individual entertainers, substitutions in the case of O-beneficiaries will not be permitted. Thus, a new petition will be required in the case of a change of beneficiary. Substitutions of beneficiaries are not permitted on O-2 petition cases.

Substituting P’s Beneficiaries

Beneficiaries may be substituted on P-1, P-2, and P-3 petitions for other groups. It should be noted that all groups qualified for P status may benefit from the substitution procedures. The petitioner must submit:

• A letter requesting the substitution

• Copy of the Form I-797, Notice of Action, to the consular office

• Alien's date of birth, country of nationality and

• Position (must certify that the alien is qualified to fill the position described in the approved petition).
