TREATY TRADERS & TREATY INVESTORS


Section 101(a)(15)(E) of the Immigration and Nationality Act provides non-immigrant visa status for a national of any of the countries with which the United States maintains an appropriate treaty of commerce and navigation, who is:

(i) coming to the United States to carry on substantial trade, including trade in services or technology, principally between the United States and the treaty country, or

(ii) to develop and direct the operations of an enterprise in which the national has invested, or

(ii) is actively in the process of investing a substantial amount of capital in a bona fide enterprise in the United States, as distinct from a relatively small amount of capital in a marginal enterprise solely for the purpose of earning a living.

  • IMPORTANT NOTICE concerning non-Mexican (TCN) applicants:
    Juarez does NOT accept Non-Mexican E1/E2 applicants or renewals of E1/E2 cases.
    Acceptance of applications for this classification is limited to applicants residing in Mexico.

Duration of stay:

A visa is not a guarantee of entry into the U.S.  The Bureau of Customs and Border Protection (BCBP) officer at the port of entry determines whether or not you may enter and the authorized duration of stay. If you hold a category "E" visa, you may live in the U.S. only as long as the business remains a real and active enterprise and the ownership remains intact. This is not an immigrant visa!
